150The Council of Europe Convention on Offences Relating to Cultural Property (Nicosia, 2017), which is today in force for six States, aims to establish a uniform regime in a field where the prevention and suppression of the main crimes (illegal trafficking and destruction) presents several difficulties. In fact, the different attitude of States, including European States, as regards cultural property has its consequences also in criminal matters, depending on whether domestic legislation understands cultural property as the expression of the spiritual and cultural identity of a nation or as goods freely circulating in markets. As a result, the Nicosia Convention, together with provisions that establish uniform types of crimes and enhance cooperation in criminal matters among States parties, allows Parties to cast reservations that essentially nullify some of its main obligations and contains some provisions that seem inadequate to ensure a sufficient deterrent effect
