This paper deals with health and safety crimes, proposing a reflection aboutthe selectivity of the process of criminalization at the level of the penalproceeding. The paper start from the sentences pronounced by the Courtof Turin in the Eternit and ThyssenKrupp cases to stress the relationshipbetween criminalization processes and organisational choices of the publicprosecutor office. Prosecutor's organisational choices and interpretation onthe constitutional constraint on the compulsoriness of the penal action areconnected with the penal political goals pursued by the offices. The paperaims to stress the link between the processes of criminalization of health andsafety crimes and the local legal culture characterizing the judicial office.
