The article analyses the possibility of carrying out constitutional review of the legislative process, the latter have been rarely experienced in Italy. With regard to this issue the author underlines that the violation of constitutional principles during parliamentary debates and approval of laws is strictly linked to the autonomous electoral legitimisation of the Government. Furthermore, she also highlights the fact that recent constitutional case law has declared the abovementioned principles to be inviolable. The Court in fact argues that these principles are closely related to the protection of fundamental rights, which the law itself should uphold.
