The pronunciation of the constitutional sentence n. 181, June 10, 2011, offers the opportunity to analyze the regulation of compensation for the expropriation of farmland. In particular, the decision n. 181/2011 stands at the culmination of a process aimed at enhancing the actual characteristics of the property expropriated for the purpose of quantization of just compensation. The author begins with the description of the system of “medium agricultural value” – VAM to explain the gradual repeal by the Constitutional Court: against a system of abstract computation and unhooked from reality, and therefore incompatible with articles 117 and 42 of the Constitution, imposes the need to consider, even for the farmland or non-building land, the market value of the property as a tool by which to ensure does not deviate to a private “serious compensation”. The discussion focuses on the description of the constitutional values at stake and ends with an indication of the doubts that have not dissolved, however innovative, case 181/2011.
