The proposal for a directive on corporate sustainability due diligence contemplates the direct civil liability of transnational companies for the negative impacts on human rights and environment of their value chains; therefore, it could be an advanced tool both to fight the impunity of multinationals and to create a European Area of Justice for people around the world. This paper is aimed at verifying whether, and to what extent, this objective can be said to be achieved. With this purpose, outlined the latest regulatory and jurisprudential developments, the subjective and objective scope of the introduced liability has been carefully investigated, also specifying the relationship with the ordinary principles of the law of tort. The private international law issues connected to the transnational character of the liability has been then examined. The limits and gaps found – even with the recognition of the undoubted innovativeness of the discipline – lead to a judgment of limited effectiveness which it is hoped to overcome thanks to specifically recommended changes.
