This paper aims to analyse the competing approach of the European Court of Justice (ECJ) and the European Court of Human Rights (ECtHR) regarding the protection of fundamental rights of those individuals and entities claiming to be victim of smart sanctions. The analysis will be conducted in the light of both UNmandated sanctions and European autonomous restrictive measures with a view to underlining that, regardless of what kind of measures the ECJ is confronted with, it will apply the same standard of judicial review. In this regard, it will be argued that the Kadi case, adjudicated by the same Court, has influenced not only the future European case-law, but also helped ECtHR to abandon the deferential attitude towards the United Nations to such an extent that, in the Al-Dulimi case, the principle of equivalent protection has been applied to the UN Focal point in order to assess the alleged violation of article 6 of the European Convention of Human Rights (ECHR)
