In the framework of the subsidiary and dialectical relationship between the ECtHR and national courts, the discipline of surrogacy, although initially assimilated to that form of slavery defined as "trafficking in human beings", is increasingly orienting itself towards forms of protection inspired by the superior and exclusive interest of the child that art. 8 of the ECHR provides for vulnerable family relationships. Despite its merits, however, such an approach does not prove capable of affecting the anti-legal and anti-social mentality that distinguishes surrogacy practices and that the Italian Private International Law (PIL), on the contrary, contributes to counteract. An action to raise awareness in favor of the creation of a solid culture of PIL, which has at its center the individual and his ability to selfregulate, connect and interact, could in this sense represent a useful contribution to affirm appropriate models of individual and collective responsibility and to facilitate, therefore, the abandonment of slave-type models
