In the context of the launch a new phase of reform of the Common European Asylum System, marked by the adoption of the new Pact on Migration and Asylum, this paper aims to investigate the role of the European Courts in defining the content of the right to asylum, in an attempt to identify a benchmark for the interpretation of the legislation on the subject, both in a de iure condito and de iure condendo perspective. Through an analysis of the jurisprudence of the Court of Justice and the European Court of Human Rights, the study will try to identify the scope of application of the right of asylum, evaluating the opportunity to incorporate within it different guarantees, both of a substantive and procedural nature
