Based on the analysis of the Statuto Albertino, the article attempts to reconstruct the passagefrom an Ancien Régime judiciary to a judiciary based on the codes and constitutionin the Kingdom of Sardinia. The conflict between judiciary and legal profession, an expressionof class conflict between the aristocracy and the bourgeoisie, is also investigated. Aftera failed attempt to find a compromise in order to preserve the privileges of the high courtsjudges (especially the rule which prohibited transfers without consent), the relationshipbetween politics and the judiciary assumed the characteristics that it would keep in the unifiedItaly after the Urbano Rattazzi laws.
