390The Author analyses the recent Fiat affair, with particular regard to Pomigliano d'Arco and Mirafiori plants, by using the prism of the commitments multinational companies are required to respect by international organisations. In this perspective, she highlights the disruption of the union relations system and the unscrupulous way the rules of our legal system are overstepped to get close to the Us attraction pole. This is realis ed not only by making regulatory regimes compete against each other but also by forcing the exit door of the contractual system, establishing a new arrangement. Thus the shopping season is declared closed while the self-referential one open, as the company acts like an economic power that builds up its own rules, even the contractual ones with chosen actors, who are taken hostage with occupational blackmail and de-localisation threat. The test-bed is the closing-provision of the contractual article on absenteeism, which sets a balanced weekly management of the paid leaves provided by law and collective agreement.
