The new security introduced in Italy by the law 2016/119, art. 1, presents substantial differences with respect to the pledge regulated by the Civil Code and some similarities with the English floating charges. Therefore, it is the subject of many doctrinal discussions. The essay aims to contribute to this debate by examining the interpretative questions that have arisen about the application field of the rules concerning the new kind of security.
