The legal-philosophical approach to constitutionalism reaffirms the utility of a critical analysis such as that proposed by the philosophy of law. Constitutionalism constitutes a legal context in which the essential questions in the philosophy of law are reproduced and placed in a new light. To a significant extent, these questions are now conditioned by a thick right from the standpoint of their contents. This essential dimension, which also affects the concept of democracy, makes it possible to think about the utility of approaches complementary to the exclusively neutral ones.
