This contribution takes the Constitutional Court decision no. 115/2011 as a starting point for studyingrecent trends on powers of order. Art. 54 of legislative decree on local authorities, about ordersof the mayor, regulates government practice in the field of civil protection orders, which arebecoming instruments of ordinary administration rather than emergency instruments. Thesetrends are objected by Constitutional Court, since they originated undue strengthening of the chiefof the executive and, therefore, an alteration of the form of government provided by the Constitution.
