This note analyzes the ideas exposed by AndreiMarmor, professor at the University of Southern California, in his recent book Philosophyof Law. In this volume, Marmor proposes a re-formulation of the positivistic model - in the "exclusive"trend - and tries to supersede some of the main critiques made to the model. His proposalis the subject of many critiques in this note, mainly about its methodological reductionismand the intent of justifying the authority and obligatory nature of the law only on social facts.
