The long life of Hans Kelsen (1881-1973) passed through two World Wars and three exiles. This is the reason why his works tackle the topic of war both from the biographical and the theoretical points of view. The uncertainty about the outcome of WWII lead the Austrian jurist to leave Germany (his first exile) and the neutral Switzeland (his second exile) toward the US, where he was investigated in the McCarthyist years. In his works, Kelsen proposed the ‘peace though law’ notion. Today his theories should be confronted with the totally new conditions established by the hybrid warfare.
