The essay highlights the spontaneity as a source of constitutional law. Several institutions in Italian constitutional history have arisen without a specific legislation. This article focuses on the spontaneous development of the government formation process (during the first year of enforcement of the Statuto albertino) through its various stages: designation/ appointment of the President of the Council of Ministers, ensuing appointment of Ministers; (preventive, successive) vote of confidence of Parliament in the whole Government (even in secret session); vote of no-confidence in the Government or a single Minister.
