The article analyses the limits and perspectives of application of the principles contained in the judgment no. 238/2014 of the Constitutional Court in the framework of the Italian courts. In particular, the author considers the application of the counter-limits on human rights laid down in the judgment no. 238 in the context of immunity of foreign state from enforcement measures, of immunity of international organizations and of immunity of State's organs.
