The author focuses on a significant decision of the Italian Corte costituzionaledeclaring the partial illegitimacy of art. 19 Statuto dei lavoratori(Act no. 300/1970), as amended by the 1995 referendum. In the essayattention is firstly paid on the impact of this decision on managementstrategies aimed at excluding dissenting unions from access to trade unionrights at the workplace level (as in the recent Fiat case); secondly, theauthor deals with some questions which still remains open, so to suggestthe need for legislation to solve them.
