The recent dispute about commons has in Italy a political nuance that is missing elsewhere. Even in the meagre legal literature devoted to the subject, the defence of ‘commons’ from dispossession by public or private hands is always perceived as radically transformative for the current political and economic system. The paper intends to present a few themes to address the question of urban space as common good in the terms it appears to legal investigation, gathering around an idea usually perceived as militant a series of problems which, although all determined by systemic choices, appear unrelated: right to housing and creation of shopping centres in the metropolitan suburbs, ‘gentrification’ and enclosure of portions of public space in gated communities, security and control in the organisation of urban space. The common feature linking the suggested solutions is found in the promotion of an egalitarian use of the city as evoked by the very notion of ‘civic commons’ or ‘urban commons’: its political relevance, as a place of meeting and conflict among the different actors on the social scene, is thus opposed to programmes for the redevelopment of urban areas that, relying on a sort of community rhetoric, create gentrification, gated communities and inequality.
