In February 2019 the European Parliament approved the text of a new Fisheries Partnership Agreement between the European Union and the Kingdom of Morocco which expressly includes, in the fishing zone, the adjacent waters of Western Sahara. This specific inclusion followed the judgment delivered by the Court of Justice of the European Union on 27 February 2018 which found that the precedent Agreement did not apply to those waters. Therefore, this paper first summarises the proceedings before the Court and analyses its judgment; then, in the second part, it dwells on the concerns that the new Partnership Agreement raises for the rights to self-determination and sovereignty over natural resources of the Sahrawi people.
