The paper deals with art. 12 of the Institute of International Law Resolution on Human Rights and Private International Law on the right to be registered immediately after birth and to obtain an iden-tity document. The study analyzes the impact of this fundamental right on some private international law mechanisms, with particular regard to the recognition of identity and citizenship, and its rela-tionship with international movement of persons, the case of families belonging to ‘gender’ minorities and surrogacy born children
