Il caso Cartesio e la libertà di stabilimento delle società nell’Unione europea

Il presente lavoro mira ad analizzare nel dettaglio la più recente pronuncia della Corte di giustizia dell’Unione europea (allora Corte di giustizia delle Comunità europee) in materia di libertà di stabilimento delle società, diritto garantito sin dalle origini dal trattato istitutivo della CEE, ma tutt’ora privo di un’efficace attuazione. L’importanza cruciale della decisione della Corte nel caso Cartesio si spiega soprattutto con il fatto che l’attuazione della libertà di stabilimento delle società all’interno dell’Unione europea è stata sinora affidata completamente alla giurisprudenza comunitari, nell’inerzia del legislatore comunitario che non ha saputo, o voluto, introdurre degli strumenti davvero efficaci in tal senso. Le conclusioni dell’analisi svolta, se mettono in luce gli sforzi interpretativi del giudice comunitario, rendono del tutto evidente la necessità di un intervento normativo dell’Unione in tale ambito che consenta davvero una piena attuazione di uno dei diritto fondamentali di circolazione.
Abstract
This work is intended to provide a deep analysis of the last judgment of the European Court of Justice concerning the freedom of establishment of companies. This right dates back to the Treaty establishing the European Economic Community but it still has to be fully and effectively enforced. The fundamental importance of the decision of the ECJ in the Cartesio case is evident when considering the key role played by the ECJ in the effective and full implementation of the freedom of establishment of companies with the hard task to find a remedy to the inactivity of the European law maker. The results of the analysis clearly show that, notwithstanding the immense efforts of the ECJ in interpreting the rules of the Treaty, an active initiative of the European law maker can not be postponed anymore.
